Terms of Use

Hobs Space – International consolidated version. These Terms of Use set out the terms of access to and use of the Hobs Space platform.

Welcome to Hobs Space

These Terms of Use (hereinafter the “Terms”) are intended to define the terms and conditions for accessing and using the Hobs Space platform, including the website, applications, public pages, related features and all services offered (hereinafter the “Service”).

Access to or use of the Service constitutes full acceptance of these Terms.

If you do not accept these terms, you must not use the Service.

1. Definitions

Hobs Space / we / our: refers to the entity operating the Hobs Space platform.
User / you / your: any person accessing or using the Service.
Account: a personal space created by a User.
Hobs Space Page / Page: a public, customized page created via the Service.
Content: any content published by a User (texts, images, videos, files, links, data, etc.).
Visitor: any person viewing a Page without necessarily having an Account.

2. Acceptance and changes to the Terms

2.1 Acceptance

Use of the Service constitutes acceptance of these Terms.

2.2 Changes

Hobs Space may change these Terms at any time.

Changes take effect upon publication.

If a change has a significant and adverse impact on the User, Hobs Space will make reasonable efforts to inform Users at least 30 days before it becomes effective.

3. Conditions for accessing the Service

3.1 Minimum age

The Service is reserved for persons aged at least 15 years.

Minors represent that they have the authorization of their legal guardian.

3.2 Account creation and security

Certain features require creating an Account.

The User agrees to:

provide accurate and up-to-date information,
keep their credentials confidential,
report any unauthorized use of their Account.

Any activity carried out from an Account is deemed to have been performed by its holder.

3.3 Username

The username must not:

infringe third-party rights,
be misleading or impersonate an identity,
contain unlawful, offensive or inappropriate terms.
Hobs Space reserves the right to reassign inactive usernames after 6 months of inactivity.

4. Description of the Service

Hobs Space enables, in particular:

creating customized public pages,
sharing links, content and files,
generating QR codes and using NFC technology,
accessing audience statistics,
integrating third-party services,
participating in monetization programs.
Available features may vary depending on the subscribed plan.

5. License to use the Service

Hobs Space grants the User a personal, non-exclusive, non-transferable and revocable license to use the Service in accordance with these Terms.

Any unauthorized use is prohibited.

6. Rules of use

In particular, it is prohibited to:

use the Service for unlawful or fraudulent purposes,
infringe intellectual property rights,
distribute unlawful, misleading or harmful content,
circumvent security measures,
use unauthorized automated tools (bots, scrapers),
create multiple accounts to circumvent limitations,
resell or exploit the Service without written authorization.

7. User Content

7.1 Responsibility

The User is solely responsible for the Content published and represents that they have all necessary rights.

7.2 License on Content

By publishing Content, the User grants Hobs Space a non-exclusive, worldwide and royalty-free license, strictly limited to:

hosting,
display,
technical distribution,
proper operation of the Service.
Hobs Space does not acquire any ownership rights in the Content.

7.3 Prohibited content

In particular, the following are prohibited:

illegal, hateful, violent or defamatory content,
infringing content,
spam, phishing, disinformation,
promotion of illegal activities.
7.4 Moderation — Hobs Space reserves the right, without obligation, to remove or restrict any non-compliant Content and to suspend the Accounts concerned.
7.5 Backups — The User is responsible for backing up their Content. Hobs Space does not guarantee retention of Content after Account deletion.

8. Creators, affiliations and monetization

8.1 Transparency and legal obligations

Users participating in monetization or affiliate programs agree to:

comply with applicable advertising and consumer protection laws,
clearly disclose any commercial relationship, affiliation or benefit received,
not hide or remove disclosure notices.
8.2 Seller of Record
When the User sells products or services via Hobs Space, they act as the seller of record and are solely responsible for:
the sale,
fulfillment,
refunds,
tax and legal obligations.
Hobs Space acts solely as a technical platform and is not a party to transactions.
8.3 Tax responsibility — The User is solely responsible for tax filings and payments related to revenues generated.

9. Third-party services

The Service may integrate third-party services (Spotify, YouTube, Instagram, etc.).

Hobs Space is not responsible for their operation, availability or terms.

10. Statistics and analytics

The statistics provided are indicative and provided “as is”.

Aggregated and anonymized data may be used by Hobs Space to improve the Service.

11. Payments and subscriptions

Certain features are available through a paid subscription.

Applicable terms are defined in the Terms of Sale (CGV).

12. Termination

12.1 By the User

The User may delete their Account at any time.

Deletion is final.

12.2 By Hobs Space

Hobs Space may suspend or terminate an Account in the event of:

violation of the Terms,
fraud or abusive use,
non-payment,
risk to the security of the Service.
Termination of the Account does not automatically entitle the User to a refund of amounts paid, in accordance with the Terms of Sale.

13. Feedback and Beta features

13.1 Feedback

Any feedback, suggestion or idea submitted may be used freely by Hobs Space, without any obligation of compensation.

13.2 Beta features

Certain features may be offered on an experimental basis, without any guarantee of availability or reliability.

14. Warranties and liability

14.1 Disclaimer of warranties

The Service is provided “as is” and subject to availability.

14.2 Limitation of liability

To the fullest extent permitted by law, Hobs Space’s total liability is limited to the amount paid by the User during the last 12 months, or €100, whichever is higher.

This limitation does not apply to mandatory consumer rights.

14.3 Indemnification

The User agrees to indemnify Hobs Space for any loss resulting from their use of the Service or their Content.

15. Personal data

Personal data is processed in accordance with the Privacy Policy.

16. Governing law and jurisdiction

These Terms are governed by French law.

Subject to mandatory consumer protection rules, the competent courts will be those within the jurisdiction of the Paris Court of Appeal.

17. Final provisions

If any clause is found invalid, the remaining clauses remain valid.

Failure to exercise a right does not constitute a waiver.

Hobs Space may assign these Terms without restriction.
